Terms of Service

The agreement between Kaidence and the business that signs up for an account — read alongside the Privacy Policy and the Data Processing Agreement.

1. These terms

These terms are an agreement between Kaidence ("we", "us") and the business that creates a Kaidence account ("you", "your business"). By signing up, you agree to these terms.

2. The service

Kaidence provides a 24/7 AI assistant that chats with your customers, captures leads, drafts quotes for your review, requests appointments, and sends automated follow-ups, alongside a dashboard to manage all of it.

3. Your account

You must be a genuine trading business or sole trader, provide accurate information when signing up, and keep your login credentials secure. You're responsible for activity on your account.

4. Fees & billing

Current pricing is discussed and agreed during your consultation — a Starter plan for individual owners and a Growth plan for small teams. There are no setup fees, and you can cancel at any time; we don't offer refunds for partial billing periods unless required by law.

5. Acceptable use

You agree not to:

  • Use Kaidence to send spam, harass anyone, or collect personal data unlawfully
  • Configure your assistant to impersonate a human employee or make guarantees you can't keep
  • Try to disrupt, reverse-engineer, or gain unauthorised access to the service
  • Use the service for anything illegal under the laws of England and Wales

6. Data protection roles

When your customers chat with your assistant, you are the data controllerfor their personal data — you decide what it's used for. Kaidence is your data processor, handling that data only on your instructions and as described in our Data Processing Agreement, which forms part of this contract.

7. AI output & your responsibility

Draft quotes, lead summaries, and messages generated by the assistant are estimates and drafts— not final commitments. You're responsible for reviewing and approving every quote before it's treated as final, and for checking that appointment and job details are correct before relying on them. AI-generated content can occasionally be inaccurate; use your judgement.

8. Payments to you via Stripe

Payments your customers make for approved quotes are processed by Stripe under Stripe's own terms. Kaidence facilitates the checkout but is not a party to the underlying transaction between you and your customer, and isn't responsible for chargebacks, refunds, or payment disputes beyond providing you the relevant records.

9. Ending the agreement

Either of us can end this agreement at any time; you can cancel from your dashboard settings. On cancellation, your assistant stops responding to new enquiries, and we'll retain your data for 30 days in case you want to export it or come back, after which it's deleted in line with our Privacy Policy.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't legally be limited. Subject to that, our total liability to you arising from these terms is limited to the amount you paid us in the 12 months before the claim, and we're not liable for indirect or consequential losses (like loss of profit or loss of business opportunity).

11. Governing law

These terms are governed by the law of England and Wales, and any disputes will be handled by the courts of England and Wales.

12. Changes to these terms

We may update these terms as the service evolves. We'll let account holders know of any material change before it takes effect.
